NEW DELHI: The Uttarakhand high court on Thursday quashed a 2018 state government order rejecting pension to Mohini Devi, widow of a freedom fighter, citing a 2014 rule mandating benefits for dependents of only those who had served over two months in jail. Devi, who is in her 80s, lost her husband MD Kabdal in 1978.
Her lawyer produced documents to prove Kabdal was sentenced to a day in jail and fined Rs 20. When he failed to pay up, he was given two months’ RI. Although there was no material to show that he was jailed, the HC said it could be assumed he was sent to prison as there was no material to show Kabdal paid up.
“It’s painful to see dependents of freedom fighters whose sacrifices made us free … waiting for decades for pension,” the court said.
